Commission approves review of 16 TAC chapters on auditing, advertising and cash/credit rules

Special counsel Matt Diamond told commissioners June 24 that staff proposed a rule review under the Texas Government Code to determine whether existing rules should be repealed, readopted or readopted with amendments. The review covers 16 TAC chapter 41 (auditing), 16 TAC chapter 45 sections 101'127 (advertising and promotion) and 16 TAC chapter 45 sections 130'131 (regulation of cash and credit transactions).
Commissioner Scott Adkins moved to approve the review; Commissioner Mac seconded the motion. The chair called the vote and the motion was recorded as approved. Diamond said staff will post the review for public comment and will consider written comments received by Aug. 3, 2025, as part of the review process.
Why it matters: the four-year mandatory review gives staff and the public an opportunity to evaluate whether the rules continue to fulfill their original purpose and to propose updates, clarifications or repeals. The public comment period will be open in accordance with statutory timelines.
Ending: Staff will post the rule-review notice and return to the commission with any recommended rule changes after public comment and internal consideration.
