Plan commission recommends code change to remove 30‑day postponement cap to align GDC with state law

The Garland Plan Commission on June 23 recommended approval of ordinance 25‑06, an amendment to the Garland Development Code (GDC) that removes a 30‑day maximum postponement period for municipal action on plans or plats, aligning the local code with changes to the Texas Local Government Code.

Michael Waitem, the planning administrator for long‑range planning, told commissioners the change is a small, utilitarian amendment to reflect recent state law updates: “This is very small, utilitarian type of change, just bringing us into alignment with state law,” he said. Waitem explained the state removed the 30‑day “shot clock” requirement for plats in 2023 and staff are updating the local code to match the current statute and the city’s recent February ordinance revisions.

Commissioner Jenkins and others raised questions about the draft language and subsection formatting — specifically whether a paragraph should be re‑indented or moved to a separate subsection so the rule reads clearly. Staff acknowledged a packet reference error caused by the eCode site not reflecting earlier February amendments and agreed to correct the formatting language before the ordinance proceeds.

Commissioner Jenkins moved to recommend approval with a technical amendment: move subsection C out to its own paragraph (to correct indentation/formatting). The motion passed unanimously.

Staff said the change will reduce confusion between city code and state code going forward and that staff will continue to advise plan commission to postpone to a date certain when feasible to avoid repeated public notifications.
