Marion council approves sale of portions of vacated alley to adjacent property owners

The Marion City Council on Thursday approved two resolutions to sell portions of a vacated east–west alley between Ninth and Tenth Streets and between Fourth and Fifth Avenues to adjacent property owners.
City staff told the council that the alley had been vacated on May 22 and converted to real property eligible for sale. Staff said they contacted adjacent owners; northern-side owners replied with interest while the southern-side owners did not, so staff recalculated purchase prices and proposed selling the 10-foot width adjacent to the northern owners. Staff identified one 10-by-70-foot swath proposed for sale to Barron Rentals LLC for “just over $1,200.” The northern halves adjacent to two other parcels were identified in the staff presentation as belonging to Mark and Laura Steffek.
At the meeting council approved Resolution No. 32437 to sell the parcel adjacent to 905 Fifth Avenue to Barron Rentals LLC and Resolution No. 32438 to convey adjacent alley portions to the owners identified in the motion. Both resolutions passed on affirmative votes. The roll-call recorded the council voting “yes” for Council Member Jensen, Council Member Harper, Council Member Miskman, Mayor Nicholas Abu Wasili, Council Member Menser and Council Member Brandt for Resolution 32437; council later recorded a similar unanimous voice/roll call for Resolution 32438.
During the public hearing portion of the item, a former Public Works Board member, Joe Spinks of 316520 Ninth Avenue, spoke briefly in support of the action while thanking the city for the opportunity to serve on the board. No written comments opposing the sales were recorded by staff prior to the meeting.
The sales will transfer ownership of the specified alley strips to the purchasers as described in the resolutions. The staff presentation explained the proposed parcel widths and recalculation of prices were driven by the lack of response from southern-side owners; the city did not provide additional price detail beyond the example price shown for the Barron Rentals parcel.
Minutes and the adopted resolutions will provide the legal descriptions and final purchase prices for the conveyed strips.
Ending: The council moved on to other business after the votes; staff indicated the formal conveyance paperwork and recording will follow city policy on real-property disposition.
