The Brownsville City Commission on June 17 approved a resolution to dissolve the Madera/Espírito Santa Public Improvement District (PID No. 1) and proceed with re-establishment to correct errors in noticing and property alignments.
City staff and a representative for the developer, Dennis Sanchez, told the commission that language was omitted from the original PID creation documents and that concurrent dissolution and reformation was the cleanest remedy. Sanchez told the commission that attorneys for both sides are collaborating and asked the commission to approve the related agenda items.
The public hearing on the PID included discussion of how assessments would be apportioned; Sanchez said the parties were discussing using valuation as the apportionment method rather than a fixed-per-lot charge or square footage. Commissioners closed the public hearing and voted to approve the dissolution and the related establishment items; motions carried on voice vote.
The commission’s resolutions referenced chapter 372 of the Texas Local Government Code as the statutory authority for creating and dissolving PIDs. The items approved included formal notices to be filed with the Cameron County Clerk as required by law.
