TCEQ adopts new standard permit for temporary concrete batch plants supporting public works

The Texas Commission on Environmental Quality on June 18 adopted a new nonrule air quality standard permit for temporary concrete batch plants supporting public works projects, implementing changes required by Senate Bill 1397 (88th Legislature) and 30 TAC subchapter F.
Michael Wilhoite of the Air Permits Division presented the item and described revisions made in response to public comment: the permit now allows a daily production limit as an alternative to a strict 12-hour-per-24-hour cap; it permits paving with a hard cohesive surface as an alternative dust-control measure for roads and traffic areas; requirements related to stationary engines were removed; and a proposed registration fee was dropped. Staff recommended issuance and sought authority for non-substantive edits required for Texas Register publication.
OPIC, represented by Sheldon Wayne, supported the adoption and said the commission conducted a protectiveness review showing the permit is protective of human health and welfare. "The creation of the standard permit is necessary to properly implement recent legislation," Wayne said.
Commissioners acknowledged extensive public engagement and staff work to address comments. The commission voted to adopt the standard permit and issue the executive director's proposed order; the motion passed on a voice vote.
The ED was authorized to make non-substantive revisions needed for publication in the Texas Register.
