Panel advances bill to shield tribal financial records from public disclosure

The Senate Judiciary Committee passed AB 1004, which would make confidential tribal financial information provided to state or local agencies solely to obtain public financial assistance. Supporters said the measure protects tribal sovereignty and prevents tribal proprietary financial data from becoming public once shared for grant or loan consideration.
Assemblymember Wallace presented the bill, describing tribes as sovereign governments and saying uncertainty under the California Public Records Act discourages tribes from seeking state and local financial partnerships. Chad Mays, an advocate for the Saboba Band of Luiseño Indians, testified the bill clarifies confidentiality for records submitted only to secure public assistance and will not affect agencies’ ability to audit or review funds used.
Representatives of multiple tribal governments and gaming associations spoke in support, and committee members heard that the measure has bipartisan backing and that sponsors had not identified opposition. A supporter said the bill "adds no cost, no new bureaucracy and has bipartisan support because at its core, it's about fairness and respect." Committee members moved the bill and the motion passed; the bill will advance to the Senate Appropriations Committee for further consideration.
