The Forest Park governing body approved the rezoning of 5116 Sergeant Street from RS (single-family residential) to RT (two-family residential) on June 16 with stipulated conditions recommended by staff and the planning commission.
Staff told council the property is located at the southeast corner of South Avenue and Sergeant Street in Ward 3 and spans approximately 0.208 acres. Clayton County property records reflected the site as a two-bedroom, one-bath ranch-style home; however, a visual inspection indicated the structure now reads as a two-story building. Planning staff said the structure appeared to have been used as a duplex historically but that permits for a second level or for conversion were not on record. Planning staff and the applicant confirmed inspections were performed during permit processing and that the applicant had pursued planning commission review, which recommended approval with conditions.
Council members asked whether the change would constitute spot zoning and whether approvals could be relied on by other properties; staff clarified the approval would be limited to this parcel and that a conditional rezoning would not allow nearby properties to “ride the coattails” of this action. Staff also explained the maximum dwelling-unit densities for RS (five dwelling units per acre) and RT (eight dwelling units per acre) and noted the applicant would need to appear again before planning for variances tied to the conditions of approval to achieve full compliance.
The applicant said inspections had been completed and that work (siding, roof) did not add square footage; the applicant stated the structure had long been used as a two-family residence. Planning staff included stipulations in the ordinance for compliance and conditioned the rezoning on those items.
Council approved the ordinance adopting the rezoning and the staff-stipulated conditions. The decision record shows the planning commission had recommended approval and staff will track the applicant's follow-up with planning for any variance requests required by the conditions.
