The North Bend City Council approved a resolution Tuesday authorizing the mayor to execute an access and utility easement agreement and a quit claim deed related to a previously approved vacation of Elm Way.
Staff said the action is the final step of a two-step vacation process. A developer (90 NB Investments LLC) petitioned to vacate a dead-end segment of Elm Way east of its triangular parcel and offered $337,850 for the segment. The council’s action accepts that payment and authorizes the city to relinquish ownership of the east half of the right of way while receiving an access and utility easement across the east half for city purposes.
Public access to the corridor will remain; city staff noted the segment is a seldom-used dead-end road that terminates at Gardner Creek. Tanner Electric, which maintains a substation nearby, confirmed it needs 24/7 access and staff indicated the easement language protects existing utility access. Councilmember Chris Coulon moved approval of AB25-097 and Councilmember Errol Tremolotta seconded; the resolution passed unanimously.
The city will record the quit claim deed, accept the payment and hold the agreed easements to preserve utility and public access rights while allowing the developer to proceed with adjacent private development.
