Council tables resolution to authorize city clerk to issue administrative citations

The Rochester City Council voted to table a resolution that would have authorized the office of the city clerk to issue administrative citations under chapter 1-2 of the Rochester Code of Ordinances. The motion to table passed 5'2; Council members Miller and Dohring voted nay.

City attorney's office and city clerk staff explained the change would have codified that the clerk's office—already the licensing authority for types such as alcohol and gambling licenses—could issue administrative citations for violations tied to those licenses, similar to the authority parks and public works have for nuisance and property maintenance citations.

Assistant city attorney and clerk staff said the underlying ordinance (chapter 1-2) already provides an administrative citation framework and the resolution sought to add the clerk's office as an entity authorized to issue citations. Staff said appeals and license revocation processes typically occur through municipal administrative processes, not the criminal court system, and that more complex appeals could proceed to judicial review if the administrative process resulted in revocation.

Council member Wall moved the item be tabled so staff could conduct outreach and provide additional detail to licensees potentially affected by the administrative change; he said several licensees had asked questions and sought clarification. Staff said they would contact licensed businesses and return the item at a later date if desired. The clerk's office indicated it could return with community outreach materials and timing in November or December if the council preferred to continue rather than table.
