Board staff said Studio 108 had previously been licensed under an earlier owner with a similar variance granted in July 2024. The new petitioner sought approval to transfer the existing variance to the new owner and to license the same space under the current ownership.
Inspectors reviewed the floor plan and an on-site inspection showed the portable sink inside the suite and the permanent dispensary sink in a hallway roughly 45 feet from the room entrance. Staff explained that the requested variance mirrored the previously approved arrangement and presented photos showing the building layout, the temporary portable sink and the permanent dispensary sink in the corridor.
After questions about whether the portable sink was in place and whether signage and sanitary measures complied with board rules, the board voted to approve the variance for the new owner to use the same arrangement (45 feet distance) that had been approved previously. Staff noted that the variance will be enforced with the same conditions required under the earlier approval and that the owner may choose to install a permanent sink in the licensed space later if desired.
Why it matters: Variances for sink and restroom placement can enable small studios and suites within multi-tenant buildings to operate while meeting health and sanitation requirements, but they require clear conditions and documented mitigation to protect public health.
