The Board of Zoning Appeals approved Variance VARDash2025Dash052 on July 17 to permit a multi-tenant outdoor storage yard at properties along North Saint Joseph Avenue, granting multiple relaxations including use of gravel in lieu of paved aisles, a reduced fence standard and limited improvements within the 70-foot thoroughfare setback.
Petitioner McCullough Capital LLC, represented by R. Layman and Son Consulting, described the proposal as a commercial lay-down yard with a 2-foot berm and a 6-foot fence at the setback line and an established tree line around much of the site. Consultant Matt Layman said additional gravel would be placed only in the rear of the site and that existing mature trees would be retained on the south boundary, with plantings in small gaps.
At the hearing board members focused on the south property line where single-family houses back up to the site. One board member said the site plan did not clearly show the south-side tree buffer and asked the petitioner to clarify what would happen if the tree line were disturbed. After discussion the board approved a motion, conditioned on replacement measures: if the existing tree line on the western edge of the southern boundary is disturbed, the petitioner must construct a continuous 2-foot berm and a 6-foot fence in a manner consistent with the berm-and-fence treatment used elsewhere along the southern boundary.
Board members framed the condition as a protective measure for adjacent homeowners; the petitioner said he preferred to maintain mature trees but agreed to the berm-and-fence requirement if trees were lost or removed. The board voted unanimously in favor on roll call: Miss Payne, Mr. Rudolph, Mr. Shetler, Mr. Zayner, Miss Cabell, Miss Kasha and Mr. Petke all voted yes.
The approval allows McCullough Capital to continue the proposed change of use and site work under the stated condition. The board recorded no remonstrators at the public hearing and asked that the tree-line/berm/fence condition be reflected in the approval.
