An appeal to the Revere Zoning Board of Appeals alleging a building-permit violation for a canopy within a required 20-foot fire lane on Naples Road was withdrawn July 23 after the building permit was surrendered to the building inspector.
The appeal concerned Building Permit B25000401, issued June 12, 2025, which petitioners argued violated condition No. 4 of a City Council special permit issued April 8, 2021 for 22 Naples Road that requires an unobstructed 20-foot fire lane along three sides of the building. Jay Satin, representing the appellant Kenneth Lafauci, told the board he believed the building permit had been withdrawn and said the petitioner would withdraw the appeal if that was the case.
City Councilor Anthony Cogliandra spoke in support of the appeal, calling the issuance ‘‘a complete mistake by the building department’’ and asking why the permit had been surrendered and whether the issue might recur. Counsel for the property owner said the permit was surrendered to avoid litigation; the owner decided not to pursue the matter because of the time and expense of potential appeals in court.
The board then voted to allow the appeal to be withdrawn without prejudice. Roll-call votes recorded Mister Lemina, Mister Lopes, Mister Pelton, Miss Pratt and Chairman Tucker in favor; Mister O'Brien was absent.
With the withdrawal final and the permit surrendered, the board recorded no further action on the matter at the July 23 meeting.
