Council rejects bids and directs rebid for Sir Francis Drake/Morrison paving project

The council on July 10 unanimously voted to reject all bids and direct staff to rebid the Sir Francis Drake Boulevard and Morrison Road paving rehabilitation project after staff received a bid protest and identified only one responsive bid.
Staff sought authorization to award a construction contract to Magoria and Gelati for $565,549 with a ministerial contingency of up to $60,000, but reported receiving a bid protest the morning of the meeting. The town manager and town attorney advised the council that, after reviewing the protest and the single-bid situation, the prudent course is to reject all bids and rebid the project to ensure competition and responsiveness.
Councilmember Matt Salter asked whether single bids are common; the public works director replied it is not common but that a single responsive bid can be accepted if it is from a responsible bidder. After public comment indicated no raised hands, the council adopted a motion to reject the bids and instruct staff to rebid. The vote was recorded 5–0 in favor.
The town will return to the council once the project is rebid and staff has evaluated responses for responsiveness and responsibility. The rebid is intended to increase competition and reduce the risk of award challenges.
