The Planning Commission recommended drafting an ordinance change to require maintenance agreements for private fire lines serving multifamily cluster housing developments, allowing the city to assume maintenance and bill property owners for repairs.
Staff explained Tennessee Department of Environment and Conservation (TDEC) has recently required some fire lines that were previously allowed as private to meet public specifications or to be taken over by the city. The city presented a proposed change that would allow a maintenance agreement for developers: the city would take over maintenance and repair for those fire lines and then bill the property owner for labor, equipment and materials.
Staff said they had discussed the approach with two developers who have pending lines with TDEC and those developers indicated willingness to have the city maintain lines and to pay for repairs under such an agreement. Staff recommended adding the maintenance agreement requirement to the multifamily cluster housing ordinance and having the city attorney review the legal language before forwarding to council; commissioners voted to recommend moving forward with the proposed ordinance change subject to city attorney review.
