The Planning Commission approved a variance from the financial guarantee requirement and voted to approve the final plat for the Sports Authority indoor recreation facility, with recording to be withheld until the city council completes the third reading to abandon an existing Livingston Road right of way.
Staff said the final plat consolidates multiple parcels and shows an abandoned right of way and dedication of new right of way on Livingston Road. Staff recommended approval of the variance from the financial guarantee requirement because bonds are already in place and an additional financial guarantee would in effect be between the city and itself. Staff also reported the final plat will not be recorded until after the council’s third reading that would formally abandon the existing right of way.
Commissioners moved and seconded approval of the variance and separately moved to approve the final plat with the variance in place. A voice vote approved both motions; the record shows the motion to approve the variance was granted, and the subsequent motion to approve the final plat carried.
Staff noted a blank entry on the property data section will be filled in prior to recording to reflect the official abandonment book/page. The developer will complete required on‑site work as part of the ongoing site contract; the certificate on the plat will show the roadway as an official city street once abandonment and recording occur.
