The Weston County Board of County Commissioners voted to approve the chairman’s signature on a replat that divides lots 21, 22, 23 and 24 in Block 11 of the original addition to the Town of Newcastle. County staff told the board the signature is the final county-level step needed before the city can approve the lot split and a purchaser can file a warranty deed.
County staff described the history: the county had previously entered a lease-to-purchase agreement for the property and received payment of $7,500 toward the purchase price. Staff said the purchaser paid the agreed amount but never filed a warranty deed because the legal description needed to describe the newly divided lots did not yet exist. The replat creates the legal description auditors and title companies require to convey the subdivided parcels.
A motion to approve the chairman’s signature was made and seconded; the transcript does not record the named mover or seconder, nor a roll-call tally. County staff said the purchaser met the payment obligation under the lease agreement but the warranty deed had not been recorded; the county therefore still holds record title to the entire lot until the plat and deed are processed.
Commissioners discussed potential future liability: the replat line runs near a retaining wall that county staff said is old and may require engineering or repair in the future. Staff reiterated the purchaser will be responsible for subdivision fees and related work required to finalize the conveyance.
No additional conditions were attached to the chairman’s signature approval during the meeting.
