The Plan Commission on July 15 approved acceptance of a stormwater pond and associated easement southwest of 2022 Olivia Road tied to the Lake Butteaux Phase 2 multifamily development.
City staff said the parcel is adjacent to Phase 2 of the Lake Butteaux development (an 80‑unit apartment and street extension). The easement will allow municipal stormwater uses as part of Red Earth LLC’s public stormwater management system and permit city access to inspect the pond to ensure it functions as designed. Staff noted the easement also allows stormwater from public rights‑of‑way and areas outside Red Earth’s property to drain through the pond; the city attorney’s office drafted the easement and Red Earth indicated it will grant the easement. Final signed documents will be recorded with the Winnebago County Register of Deeds after Common Council approval.
No members of the public spoke on the item. The commission voted 9–0 to accept the easement per the staff recommendation.
Staff recommended approval and the commission adopted the staff report findings and conditions.
