City staff told the council that Sandy City and Midvale had both been treating the roadway as a Sandy public right of way — plowing, maintaining signage and asphalt — and that records suggested the parcel had been acquired by Sandy when it built nearby water tanks, likely in the 1980s. Legal staff reviewed the quitclaim deed and made minor modifications that Sandy accepted. The deed “transfers the property to Sandy to be operated as public right of way,” while including a reservation so Midvale may continue to operate its water lines, staff said.
The transfer was presented during a public hearing. No members of the public spoke during the three‑minute public comment period. Council members then moved and seconded adoption of the resolution; the roll call recorded Council Member Billings, Glover, Robinson and Mikulasch voting in favor. The mayor announced the motion passed unanimously.
According to staff, the parcel has “no value to Midvale” for current or anticipated projects and transferring it would relieve Midvale of maintenance obligations and potential liabilities associated with property located inside Sandy City. Staff also said Midvale will retain documentation and an explicit reservation of rights covering existing water infrastructure under Size Road, and that the city has access rights to operate and maintain those lines.
The deed and the surplus process followed legal review; staff thanked “Garrett and your team” for assistance. The council moved on to other business after approving the resolution.
