Staff said the designation would allow city staff to approach performers and contractors with information showing part of proceeds could be directed to the relief fund. "Without it, we're kind of putting the cart after the horse," a staff presenter said, arguing that a formal designation would help secure sponsor commitments tied to disaster relief.
Commissioner Jose L. Morales moved to table the item pending information on the amount of proceeds, anticipated surplus from the concert series, and EDC approval; the motion was seconded and passed on a voice vote. Commissioners stressed that they supported the idea in principle but wanted to see concrete financial details before committing funds.
Legal counsel answered a procedural question about whether the city can allocate proceeds to another jurisdiction and said municipalities generally cannot give away public funds unless the expenditure serves a legitimate public purpose; in the meeting counsel said health and safety purposes can qualify.
The item will return to the commission after the EDC considers the request and staff can provide detailed estimates of concert proceeds and the proposed allocation percentage.
