The Omaha City Council on July 7 approved a set of measures (items 19–21) to rezone a property southeast of 40th and North Saddle Creek Road from GC to MBD, adopt a PUR overlay district, and grant a special-use permit allowing a restaurant drive-through. Planning staff recommended approval.
Applicant representatives described the site plan and said the drive-through would be located on the east end of the site with landscaping and screening along North Saddle Creek consistent with the North Saddle Creek streetscape improvements. The developer indicated design coordination with the Saddle Creek corridor project and estimated construction would start in spring 2026 with about 12–18 months of work.
Opponents raised concerns about transparency and prior neighborhood neglect; proponents and council members said the development fills a vacant, industrial-use site and has neighborhood and business-improvement-district support. The council approved the measures in a 7-0 roll call.
