George Agaya, principal planner, presented the small‑scale application (CDMP202501) describing the site as roughly 0.82 gross acres comprised of two current designations (low‑density residential and business‑office) and the applicant’s request to make the entire lot business and office.
Staff recommended adoption of the applicant’s preferred declaration of restrictions, which limits the building area to approximately 5,920 square feet and excludes future residential components. Applicant counsel Cesar Mestre said the client intends to build a small strip shopping center of about 5,200–5,920 square feet on a lot that has been vacant for over 25 years, and that commercial uses surround the lot on multiple sides. The applicant said this legislative path follows earlier local guidance seeking a CDMP amendment rather than pursuing a variance route.
Board action: The motion to adopt staff recommendation with acceptance of the preferred declaration of restrictions was moved by Vice Chair McRae and seconded by board member Max Lozner. The roll call recorded unanimous approval.
