The Frederick City Planning Commission approved a modification to Land Management Code Section 8.21 to allow an iron fence to be installed beyond the front façade of a home at 111 East Second Street.
Staff reported the property sits in the Downtown Residential zone and the Historic Preservation Overlay. Staff found the proposed iron fence would not impede the streetscape or visual access and cited historic precedence for a similar fence. Because of topography, staff recommended conditioning approval so that the combined height of the fence and underlying retaining wall not exceed 6 feet (72 inches).
Owner Dan Cassidy told the commission he purchased the house in 2024 and clarified a neighbor’s address noted in the staff report; the applicant and staff confirmed the owner will meet permitting requirements, including a permit review to verify the 6‑foot maximum height at the time of construction.
A motion to approve the modification, with the condition limiting fence height (including retaining wall) to six feet and correcting the neighboring address to 115 East Second Street, passed unanimously.
Staff noted that if approved, the Historic Preservation staff may administratively approve final fence details per the modified code authority.
