The issue arose after staff and board members reported repeated attempts to inspect and prompt remediation at a property where erosion-control measures, silt fencing or other temporary protections had not been completed. Mark Long and CPL (consulting engineers) had tried several site visits; the applicant told the board work would begin but the town’s inspectors had not observed progress.
Board members asked for a firmer timeline and discussed possible remedies: the applicant could hire a different contractor, the town could undertake the work and bill the owner, or the town’s counsel (Grant Lyons) could be retained to issue legal notices. Board members emphasized the owner must supply photos and progress updates; staff said the town could request daily updates and images between meetings.
The board instructed staff to contact Grant Lyons for an opinion on legal remedy options and to report back; members also asked staff to check the escrow account to ensure funds are available if the town needs to undertake work directly. The applicant was told to provide written authorization for any new contractor and assurances that the work plan approved by CPL will be followed.
No new permit or approval was granted; the board continued the public-hearing status and asked for a site update and photos before the next meeting.
