Commission recommends rezoning of Fox Meadows lot to limited single-family residential despite earlier development agreement concerns

The Pleasant View Planning Commission voted July 10 to recommend that the City Council rezone a roughly 0.29-acre parcel at 624 West Fox Meadows Drive from CP-1 (planned commercial) to LSFR (limited single-family residential).
Commission staff said the item first came before the commission in April paired with a general-plan amendment; the commission then recommended denial of the general-plan change, but the City Council subsequently approved the general-plan change. Staff told commissioners that, given the council’s action, the rezone application now aligns with the updated general plan.
Paul Pitcher, a Fox Meadows resident and petitioner, said neighborhood outreach produced more than 40 signatures in favor. “We feel as a community that it will enhance our community, with a home there instead of anything else,” Pitcher said.
Neighbor Richard Saunders, who lives near the lot and identified himself as a Pleasant View business owner, told the commission the parcel is too small and oddly shaped for a viable business and would create parking and safety problems if kept commercial. “It’s zoned for business, and there’s just no way a business can function there. It’s too small of a lot,” Saunders said.
Several commissioners acknowledged the lot’s odd shape and the original development negotiations that preserved commercial frontage along the corridor. Some members said they were surprised the City Council changed the general plan after earlier public hearings when residents had urged that that corridor remain commercial. Commissioners debated whether a residence or a future small business would be the better long-term use and discussed private-road access and HOA restrictions that could affect future access or parking.
Commissioner Chad moved to recommend approval of the rezone to LSFR with the condition that staff verify the lot satisfies required setbacks and dimension standards for the LSFR zone; Commissioner Gosford seconded. The commission approved the recommendation to the City Council, with some commissioners voicing opposition in the record to the council’s earlier general-plan decision. The motion sends the rezone to the City Council for final action and asks staff to confirm setbacks and buildable area prior to the council hearing.
Staff noted a number of practical constraints that informed commissioners’ discussion: the parcel’s irregular geometry, private-road access on Fox Meadows Drive, and that the adjacent southern parcel is under separate ownership and currently under contract, factors that limit shared parking options.
At the meeting commissioners requested that staff clarify recorded access rights for Fox Meadows Drive and any deed or HOA restrictions before the City Council considers the rezoning request.
