Following an executive session on legal matters, the Lincoln County Board of Commissioners voted on July 10 to authorize the county attorney to file an application for discretionary appeal from an order awarding attorney's fees in the case Serenity Builders v. Lincoln County. The order being appealed was entered on June 25, 2025.
The county attorney requested the board's authorization to pursue a discretionary appeal; the commission approved the motion by voice vote (motion by Commissioner Henderson; second by Commissioner Clyde). The clerk was authorized to sign the required affidavit noting that no votes were taken during the executive session.
County officials did not discuss case specifics in open session; the motion on the record authorized the county attorney to file the petition for appellate review.
