The Village of Saint Charles council unanimously adopted a resolution to affirm that the village will comply with applicable immigration law and relevant state House rules that could affect consideration of appropriations, council members said.
Adam Florie, the village attorney, explained that a change in state House practice (House Resolution 19) ties some appropriations votes to a municipality's adoption of rules stating it will comply with immigration law. "The resolution in front of you provides is simply is that we will comply with whatever the law is above us, which is which is our legal obligation, whether we like it or not," Florie said.
Why it matters: Florie and the village manager said adopting the resolution is intended to prevent administrative delays or holds on state funding that could affect the village's ability to receive appropriations or grant-related votes. The council discussed the practical impact and concluded the village has minimal day-to-day interaction with federal immigration enforcement but could be affected if a vote on funding is withheld.
Council action: The council moved to adopt the resolution and recorded a unanimous roll-call vote with Edgar Titoff absent: Paul Jendorski — Yes; Christine Newman — Yes; Michael Nesbitt — Yes; Kathy Harris — Yes; Darcy McSwain — Yes; Jennifer Rosser Nesbitt — Yes. The village manager noted that the village will continue to pursue grant funding and that adopting the resolution helps avoid procedural obstacles when state appropriations are considered.
What the resolution says: The adopted text directs the village to comply with applicable law and authorizes the village to file the approved resolution with the clerk of the state House of Representatives so the village's compliance is on record for future appropriation votes.
Implementation: The village manager indicated he plans to submit the approved resolution to the state House clerk and to continue pursuing state grant funding for local projects such as pump station improvements.
