Board feedback funnels changes to Lake County cannabis rules; staff to codify hydrology reports and reconsider setback and permit lifetimes

The Lake County Planning Commission received a detailed update on July 10 about Board of Supervisors direction on revisions to the county cannabis ordinance and related implementation policies.

Director Michelle Turner told commissioners the Board reviewed the commission's prior recommendations and offered additional direction. Turner summarized several Board preferences: not adding homeschools to a formal exclusion list because homeschools are difficult to track; exploring increased setbacks from off-site residences (discussed in the range of 500 to 1,000 feet); and considering moving indoor and mixed-light cultivation into service-commercial and light-industrial zoning districts rather than allowing those uses in rural residential zones.

Turner emphasized the Board's interest in stronger, more easily interpreted hydrology reports to answer "how much water is this going to use, how much water do we have, and what are going to be the impacts in your parcel and neighboring parcels." She said staff will codify the County Development Department's ability to require hydrology reports for discretionary cannabis permits so interpretive requirements are clearer and consistent across directorates.

Other Board feedback Turner relayed: remove the 10-year permit lifetime so permits operate for the life of the business (while retaining annual compliance reviews), consider clarifying that setbacks from public land apply only to developed public land, maintain a $5,000 bond level (the Board was comfortable with that amount), examine a maximum canopy acreage rather than unlimited canopy based on accumulated property, and explore additional mitigations for odor impacts. The Board also suggested requiring property-owner background checks and suspending permit processing if law-enforcement records show active warrants for applicants, and asked staff to explore a hearing officer or hearing board to handle appeals of planning commission cannabis permit decisions before matters go to the Board.

Turner said staff will incorporate these directions into the draft ordinance and related materials. She noted the county will review potential zoning relocations for certain cultivation types and that the countywide zoning-map update planned after the general plan update will address some overlay changes (a county-led rezone projected for 2027 to convert certain B5 overlays to a frozen status where applicable).

Commissioners and staff also discussed permit fees and the cannabis tax revenue structure. Planning staff said planning fees are set on a cost-recovery basis and are tracked against processing time; cannabis tax revenue is allocated through the county budget process for district discretionary projects, education and law enforcement and other uses as specified in county budget documents. Turner said the department will continue refining cost tracking using the county's electronic permitting system to more closely match fees to processing costs.

Turner closed by noting the Board's direction will be reflected in a revised draft ordinance and that the Board will hold a special workshop on the county's housing action and implementation plan on July 29; planning staff offered to brief the commission on housing actions at a future meeting.
