Summary

The Planning Board continued consideration of a proposed zoning text amendment to Section 409(e) on July 9 after the applicant, Connolly Law & Associates, did not appear at the hearing. The board agreed to allow the applicant to return on Aug. 13 to respond to staff comments and to allow the town planner (absent at the meeting) to participate.
Why it matters: The proposed text amendment would change how the town treats expansion of buildings or structures that are nonconforming by dimension, specifically to allow expansion of such nonconformance for multifamily residential use with a special‑use permit. Because the applicant and the town planner were not present to discuss staff comments, Solicitor Angelica Bovis said it would be prudent to continue the matter.
Solicitor Angelica Bovis told the board she had spoken with the applicant's attorney, Dylan Conley, and recommended a continuance to allow the applicant to respond and to give planning staff an opportunity to present comments. The board voted 4‑0 to continue the item to the Aug. 13 meeting.
Next steps: Applicant or its counsel to appear at the Aug. 13 meeting with responses to staff comments; town planner to be present to answer staff questions.
