Middletown planning board waives state DOT permit condition for Bridal High School project

The Town of Middletown Planning Board voted to remove a condition of preliminary approval that had required a RIDOT (state Department of Transportation) permit to be secured before issuance of a building permit for the Bridal High School project at 1113 and 1199 Aquinnick Avenue (Tax Assessor’s Plat 113, Lots 198A and 199). A motion to waive the condition was made, seconded and passed.
Peter Regan, representing the Town of Middletown, told the board the project had received the DEM permit last week and that the town had a letter from RIDOT indicating no objection to the work and saying a permit would be forthcoming. Regan said the RIDOT official who issues the permit was out on leave and that RIDOT had recommended the board not make issuance of the RIDOT permit a condition of the town’s building permit. He said a project manager had told the town the RIDOT permit would likely arrive “tomorrow,” but urged the board to rely on the RIDOT letter rather than repeated verbal estimates.
The board recorded that one member was recused from the matter and that no town solicitor was available for the hearing. After discussion, members voted in favor of removing the condition; the motion passed.
The board did not provide a roll-call vote in the transcript and did not state any additional conditions attached to the approval.
The project proponent and town representatives did not request other waivers at the hearing. The board moved on to the next agenda item after the vote.
