Richland County's executive and finance committee on July 8 approved forwarding a resolution to the full county board to delegate authority under Wisconsin Statute 48.09 that would allow corporation counsel to appear on behalf of the public in certain juvenile matters.
Administration said the county discovered that Wis. Stat. 48.09 restricts corporation counsel from appearing in juvenile matters on behalf of the public unless the county board explicitly delegates that authority; by default those matters are handled by the district attorney's office. The county's job description and prior practice assumed corporation counsel could provide this representation, but statute requires a formal delegation.
The administrator said the Department of Administration has been contacted and the district attorney (D.A. Harper) is coordinating on the process. The administration said it hoped the ordinance/resolution would not have to wait until Jan. 1 to take effect but that statutory timing may impose limits. Committee members voted to forward the resolution to the county board so the county can align internal corporate-counsel duties with state law.
Supervisor Turk moved to forward the resolution; Supervisor Daryl seconded and the committee approved the motion by voice vote.
