Council adopts ordinance to make adult-oriented businesses conditional in I-1 zoning

The North Platte City Council on July 1 adopted Ordinance No. 4203 on first reading to amend Chapter 156 (sections 156.236 and 156.237) of the North Platte Code of Ordinances, changing adult-oriented businesses from a permitted use to a conditional use in I-1 (light industrial) districts.
The ordinance language was read into the record and moved for first-reading adoption. Planning staff Judy told the council that the change would leave the substantive development standards in place but allow the city to impose additional, site-specific conditions through the conditional-use process. “Right now, it is permitted only in an I 1 district as long as it meets certain specifications,” Judy said. She said planning staff recommended the change and that there were no pending applications for that type of business.
Bill (city attorney) advised the council to evaluate each conditional use application on its merits and cautioned against arbitrary denials. “With any conditional use, you need to look at the application as presented and determine whether it meets the requirements set forth in the zoning rights,” he said. Council members cited past legal disputes in other Nebraska cities — including Hastings and Grand Island — as part of the rationale for ensuring a careful review process.
Councilmembers debated a staff request to waive the ordinance’s three required readings to expedite the measure. A motion to waive the three readings failed. The council then returned to the original motion and approved Ordinance No. 4203 on first reading.
What this changes: making adult-oriented businesses a conditional use in I-1 gives the planning and zoning process clearer authority to impose conditions such as signage restrictions, buffering or location limits. It does not, by itself, ban those businesses from the city; instead, it requires applicants to obtain a conditional-use approval before operating in an I-1 district.
