DPS nonessential-services regulations near AG review; committee told fees will be charged by man-hour when finalized

The Department of Public Safety told the House Ways and Means committee that its nonessential-services regulations — the framework to charge fees for services such as event staffing, funeral and parade escorts and construction-site traffic control — are pending with the Attorney General's office and will be published for public comment.
Deputy staff and OMB said the regulations have been drafted and are awaiting AG review; the regulator's office expected to sign off and publish in July, after which the regulations would be subject to a public-comment period. Committee members asked whether those fees could be included in the upcoming budget; DPS said the regulations must be finalized and published before collections can begin.
DPS said the rules anticipate charging by man-hour and that when regulations are adopted the department will be able to start billing entities that require police presence at events or construction operations. Committee members flagged Liberation Day and other community events as near-term opportunities for fee collection once regulations are implemented.
The committee asked DPS to share the draft regulations and schedule so legislators could consider inclusion of potential collections in budget planning.
