The Upland Planning Commission voted to approve a development of 11 townhomes at 1213 and 1253 East Ninth Street, adopting a resolution that included a tentative tract map, conditional use permit and development plan review and finding the project categorically exempt from the California Environmental Quality Act under the infill exception (CEQA Guidelines section 15332).
The project — described by staff as 11 condominium townhomes on two existing parcels that will be combined — will provide 23 parking spaces (three more than required), 2,755 square feet of common open space including a barbecue area and playground, and an HOA to maintain common areas. Buildings 1 and 2 contain one-bedroom units (two-story for the one-bed) and the remaining units are two- and three-bedroom plans with two-car garages; the one-bedroom plans include a single-car garage. Staff said two uncovered guest parking spaces will include a van-accessible ADA stall and that path-of-travel requirements will be met.
Planning staff presented the entitlements as tentative tract map number 2400002, conditional use permit number 250002, and development plan review number 240009, and recommended adoption of findings of CEQA exemption under the infill development exception. The commission conditioned the approval to require that composition roofing use an architectural or dimensional style to provide architectural relief.
Tom Lau, project architect, told the commission the applicant plans to use architectural/dimensional composition shingles ("dimensional shingle, those are 2 to 3 layers") and confirmed electric-vehicle charging will be workable at the site. He said plan check is expected to take about six months after permit approval before construction can start.
Commissioners asked for clarification on layout details including the location of the playground and turf (staff confirmed the play equipment and grass areas), the number and location of accessible parking stalls (staff identified a striped van-accessible stall), and the inclusion of in-unit laundry in the one-bedroom plans (the applicant pointed out a labeled laundry closet behind the unit door).
The motion to approve the CEQA exemption and adopt the resolution approving the entitlements passed with six affirmative votes. Staff noted a 10-day appeal period for the decision.
The commission record identifies the entitlements by the numbers above; the applicant will proceed to plan check and building permits after the appeal period expires.
