During consideration of House Bill 15-72 on June 26, 2025, Rep. Kephart offered Amendment A01333 to require the Independent Fiscal Office to perform a performance audit of the program in five years. The maker of the bill urged a no vote. The clerk recorded ayes 101 and nays 101; the amendment failed on the tie.
Earlier on the same bill Rep. Fritz rose to introduce an amendment tied to natural gas and lithium resources but withdrew it, saying he would bring it at another time.
The failed amendment would have required the legislature to obtain performance information from the Independent Fiscal Office to assess program efficiency; the sponsor of the amendment said it would ensure the state gets the most from its investment. The chair called members to vote and the clerk recorded a tie; with the vote tied, the amendment did not pass according to the floor record.
