Judicial committee tables proposed rewrite of city ethics code for further revision

The Judicial-Legislative Committee reviewed a recommended rewrite of the city ethics code prepared by the ethics committee and decided to table the draft for further revision.
Julie Livingston, attorney for the ethics committee, presented a substantially reworked draft the committee had prepared. She said the ethics committee had tried to “slim down” the code by tracking state law more closely, reducing the number of definitions, and focusing on the “substantial interest” standard. The ethics committee also proposed changes to the ethics-complaint form and to the rules and procedures for ethics complaints.
Several council members raised substantive concerns. One committee member said the draft removed or reworded provisions in ways that reduced clarity on key topics: inconsistent use of “substantial interest” vs. “substantial financial interest,” replacement of an “actual knowledge” standard with “constructive knowledge,” removal of harassment language, and a change in how gift acceptance would be treated (the draft referenced the state bribery statute rather than the prior municipal threshold for gifts exceeding $100). The speaker asked that the document be revised to restore clarity and requested that the council’s consent-agenda practice (permitting votes where an individual abstains on an item without removing the entire consent agenda) be reflected.
The committee considered comments and asked for more direction to the ethics committee. After discussion the committee voted to table the ethics-code rewrite for no more than two months, with the expectation the ethics committee would consider the council’s targeted edits and return with a revised draft. The motion to table passed on committee vote (record shows 3–0 in committee). Staff and the ethics committee attorney agreed to incorporate the requested clarifications and work with the committee chair on language before the next meeting.
The committee also tabled related rules-and-procedures and complaint-form changes to be revised in parallel with the code rewrite.
