Commission adopts two fireworks ordinances; city will not allow year-round permanent sales

Staff said the city will not permit year-round permanent fireworks retailers within Newton; the first ordinance is subject to approval by the Kansas State Fire Marshal.
The second ordinance addresses public-display permits and the city's permitting process for displays. Staff said the second ordinance does not require state fire marshal approval. Commissioners moved separately on ordinance 5168-25 (first ordinance) and ordinance 5169-25 (display/permit ordinance); both motions were seconded and each carried by voice vote.
Staff and the fire chief answered questions about the difference between seasonal stands (locked to specified sale dates) and permanent year-round retailers (which would require state approval but are being foreclosed by the city), and confirmed that public displays can be permitted outside seasonal sale windows through the city's fire-marshal permitting process used for community events.
Commissioner remarks during the meeting also noted that seasonal fireworks stands will be inspected before sales begin, and a staff member later said nine fireworks stands were set up and would be inspected on the 26th with sales starting on the 27th and continuing through the 5th (dates as stated by staff during the meeting).
