Planning commission approves CharBar minor plat, conditions easement vacation on utility consents

Senior planner Nathan Jury told the commission the application would consolidate two platted lots into a single roughly 3‑acre lot to allow construction of a barbecue restaurant and an associated pickleball facility. Jury told the commission the vacation affects a utility easement that currently contains existing utility lines and pipes for Evergy, Google Fiber and Atmos Energy.
Jury said CharBar has an agreement with Evergy to relocate its lines and is working on agreements with Google Fiber and Atmos to relocate their lines. He said consent had been provided by other utility companies and by the city utility engineering division, and staff recommended approval with one stipulation: the applicant must secure consent from Atmos and Google Fiber before recording the plat and the easement vacation.
No members of the public signed up to speak during the hearing. Commissioner Chow moved to approve MP25‑0004 as stipulated by staff; Commissioner Creighton seconded the motion. The roll call vote recorded seven yes votes and one recusal; Ms. Wells called the roll. The chair announced the motion passed 7 to 0 with one recuse.
Commissioner Corcoran recused from the item before the hearing because, she stated on the record, her firm had been involved in preparation of the documents for the application. The commission recessed briefly while the recusal was processed and Corcoran rejoined the meeting after the vote.
Next steps specified during the hearing: the applicant must obtain the outstanding consents from Atmos and Google Fiber and complete the required utility relocations before recording the final plat. Staff indicated recording will not proceed until the stipulated consents are on file.
