Wylie council approves release of 48.5 acres from city's extraterritorial jurisdiction

City staff confirmed the acreage in the ordinance was corrected from an earlier 56.5 acres to 48.5 acres before the council vote. Staff told council that, if the petition to release the land met the legal filing requirements, council has two options — approve the ordinance or take no action; if no action is taken, state law provides for approval by operation of law at the next council meeting. Staff referenced Chapter 42, Subchapter D, in the report as the governing statute for ETJ releases.
Staff explained that, after release, the properties would be served for EMS and fire through the city’s contract with the county and general law-enforcement services would be provided by the Collin County Sheriff’s Office; Wylie Police Department could assist in emergencies. Council also noted the city would no longer exercise zoning or planning authority within the released tracts.
Council amended the motion on the floor to include the corrected acreage (48.5 acres) before taking a vote. The ordinance passed by a 5-0 vote.
