Vicente, staff member, told caucus members the Senate adopted a strike-everything amendment to House Bill 2091 that would change how the Department of Water Resources evaluates certain applications for certificates of assured water supply. "[The amendment] requires the Department of Water Resources to review the merits of applications for certificates of assured water supply that were submitted between January 2021 and August 2023 and issue a new written determination if the water provider pledges an amount equal to 25% of its excess groundwater pumping to the CAGRD and long term storage credits among other criteria," Vicente said.
The Senate amendment, as described in caucus, also specifies that determinations about whether groundwater is physically available must be made using specified groundwater models from February 2006. Vicente said the sponsor concurs and offered to answer questions; no follow-up questions were recorded in the transcript and no caucus vote occurred on the measure during the session.
The transcript records the pledge threshold at 25% and the application window (January 2021–August 2023). The caucus discussion did not include the text of the other criteria referenced by Vicente or detail how the Department of Water Resources would operationalize use of the February 2006 groundwater models.
