The Planning Commission voted unanimously June 19 to amend the conditional use permit (CUP C-16-040) for The Hub, a multifamily residential building at 3848 Southwest Temple, removing a condition that required at least 50 apartments be restricted to non-driving residents.
Staff said the 2018 CUP included the non-driving-resident requirement to reduce on-site parking demand. The applicant supplied a parking study prepared by Fair and Piers (memorandum dated Dec. 29, 2023) documenting six weeks of data collection; staff summarized that peak observed parking usage was 68% of the typical parking stalls, leaving 54 stalls unused at peak. After cross-checking the built office square footage and applying the shared-parking table in the municipal code, staff concluded the site meets the on-site parking requirements in South Salt Lake Municipal Code section 17.06.0.16 with the condition removed.
The applicant, represented at the meeting by Christie Chambers (CEO, Columbus Community Center), told commissioners the non-driving restriction harmed their ability to house some clients, including participants in an autism program, because applicants with a driver's license were in some cases excluded from units. Chambers said rents will not change based on driving status and that the property area has additional nearby parking resources (including proximity to Meadow Brook TRAX station) should demand change.
Commissioners asked about potential rent impacts and parking adequacy; the applicant stated rents would not increase for drivers and that shared parking and the consultant's counts show adequate capacity. No public comment was made.
Commissioner Ewell moved to approve the amendment to CUP C-16-040 as outlined in the staff report; Commissioner Spencer seconded. The motion passed unanimously.
The amended CUP will allow the property broader tenancy eligibility without the prior "non-driving resident" restriction; the action is subject to the conditions described in the staff report and any required licensing and code compliance.
