The commission restricted approval to the ride currently in place.
Staff described how the local entertainment‑district code treats outdoor amusements. A staff member said the Padre Pilar Entertainment District code bases required parking on building size rather than ride count and that setbacks for rides are determined by the ride manufacturer. The applicant, who identified themself as Yuda, said the ride is located in a part of the property that “doesn't bother anybody,” that the ride follows safety measures including railing and anchoring to the floor, and that international builders assembled it. Yuda said the ride seats eight people and that annual inspections are performed.
Filiberto Alba, building official, told the commission the city's enforcement for work performed without required permits is to charge double the permit fee based on project valuation or a $200 fine, whichever is greater. Alba also said the city would enforce the double-fee penalty because a sub work order had been placed on the property.
Commissioner Lehi asked whether the permit requires additional parking, restroom capacity or setback specifications; staff replied that required parking is based on building size under the local code, that the existing building contains restrooms (staff said two restrooms in a small ~800-square‑foot building were present), and that setbacks are guided by the manufacturer's specifications for the ride.
After discussion, a motion to approve the specific‑use permit limited to the one additional ride currently installed passed; commissioners voted “aye.” The commission recorded that the approval applies only to that ride and that any additional rides or changes would require further review and permits.
The building official stated the city will assess the double permit fee for the unpermitted work as required by local enforcement procedures. The item concluded and the commission moved to adjourn.
