The South Gate Planning Commission on June 18 received a staff report that Conditional Use Permit No. 23‑0032 for a takeout‑only pad café with drive‑through at 9501 Atlantic Avenue has expired.
Kimberly Hernandez, housing assistant, summarized correspondence from Mario Dominguez and staff’s response; John (planning staff) explained that CUP No. 23‑0032 was approved by the commission on March 5, 2024, and that, per condition 13 of resolution 2024‑01 and the city’s ordinance, the permit expired after one year of non‑use. Staff said the applicant was notified of the expiration on May 22, 2025, and that staff had been in contact with the applicant, who indicated they were not able to move forward and understood the permit would expire.
Staff told commissioners that an applicant may submit a new conditional use permit application, pay the applicable fees, and that the reapplication process follows the same steps as a new discretionary filing: staff review, mailed notice to owners and residents within 1,000 feet, a 10‑day newspaper posting in the Daily Breeze and a public hearing before the Planning Commission. Staff also said that while the city cannot grant formal extensions by ordinance when a permit is unused, in practice staff may find that demonstrated in‑progress work (graded site or initiated construction) can be considered toward meeting permit use requirements.
Commissioner Lizette Ruiz moved and the commission seconded a motion to receive and file the report that CUP No. 23‑0032 had expired; a roll‑call vote recorded unanimous approval among present commissioners.
