Contractors Board adopts staff recommendation on SB 517, backing subcontractor-disclosure provisions

The Contractors State License Board voted to adopt staff’s recommendation on Senate Bill 517, an amended bill that changes disclosure requirements for home improvement contracts.

Board staff explained the amendment: instead of requiring a contractor to include subcontractor names when a subcontractor performs more than half the job, the amended bill requires a yes/no checkbox on a home-improvement contract indicating whether a subcontractor will be used. The amended bill also requires a disclosure that the prime contractor will provide a list of subcontractors — names, contact information, license numbers and license classifications — to the consumer upon request. The amended language reiterates that the prime or direct contractor remains responsible for the construction project and that administrative discipline could still apply to subcontractors or home-improvement salespeople.

"This bill provides greater transparency between the prime contractor and consumer and may reduce the number of mechanics liens placed on properties," staff said in the meeting summary while recommending the board take a simple position.

After asking for public comment and board discussion, the board took a roll-call vote and adopted the staff recommendation on SB 517. The chair announced that the motion passed.

Board materials referenced the committee packet (page 140) for the legislative analysis and noted the bill is pending before the Assembly Business and Professions Committee. No further amendments were adopted by the board at the meeting; staff will follow legislative developments and engage with the author and stakeholders as appropriate.
