Council finds proposed 312-acre site eligible for annexation under state law

Commerce City Council held a public hearing and voted to adopt a resolution determining that a roughly 312-acre property northeast of East 112th Avenue and Himalaya Road is eligible for annexation under Colorado’s Municipal Annexation Act.
The applicant, represented by Jason Pock, made a brief statement that a formal land-use plan and zoning request would be presented in subsequent steps. Kathleen Taylor, senior planner, told the council the annexation petition had passed an earlier “substantial compliance” check, and she walked the council through the statutory eligibility criteria: contiguity with city limits, a demonstrated community of interest or anticipated urbanization, the ability to integrate infrastructure (water, sewer, power), and that annexation would not detach an area from or attach it to a different school district. Taylor said the property is within Commerce City’s comprehensive plan growth area, abuts the municipal boundary (contiguity exceeded the statutory minimum of one-sixth), and has utilities nearby.
City Attorney Zarzecke read statutory language on how Colorado law defines “urban development” for the record. No members of the public registered to speak at the hearing. Following a motion to adopt Resolution 2025-050, Council member Craig Kim moved and Council member Rocky Teeter seconded; the council adopted the eligibility resolution by roll call vote.
Taylor and staff noted that a future annexation ordinance and accompanying zoning application will return to council for full consideration after the eligibility step.
