Department of Insurance and DOPL brief committees on rule dockets ahead of negotiated rulemaking

The Idaho Department of Insurance and the Division of Occupational and Professional Licenses (DOPL) briefed the House Business Committee on Jan. 15 about rule dockets they plan to present this legislative session.
Department of Insurance overview: Director Dean Cameron said the department is reviewing 20% of its rules this year and proposed changes to four rule chapters following negotiated rulemaking and stakeholder input. The DOI-listed changes include: cleanup of a life-settlement rule (removing provisions duplicative of statute), updates to a title-insurance rule focused on how funds move through banks/credit unions, clarifications to the surplus-lines rule and a previously contentious fire-code rule that the department said was revised after consultation with legislators to avoid criminal-penalty language that clashed with state statute. Cameron introduced staff on the record, including Bureau Chief Randy Piple and State Fire Marshal Newt Sandahl, and said the department will bring detailed dockets back to committee for action.
DOPL overview: Katie Stewart, bureau chief for DOPL’s administration bureau, summarized a broad set of rule dockets. DOPL said nine boards and three safety programs completed 0-based regulation reviews to remove ineffective or duplicative rules and renumber chapters to align with the rule writers manual. Key notes included the Building Code Board’s adoption of the 2024 NFPA edition for LP-gas, logging-safety chapter updates (described as long because statutory language requires operational safety guidance), negotiated rulemaking and temporary fee rules for the Electrical Board, and fee adjustments across several boards to comply with Senate Bill 1442 (examples: Morticians — 20% fee increase; Geologists — 20% increase; Real Estate Commission — 15% fee reduction; Building Code permit fees — 30% reduction). Stewart said DOPL will provide the committee with clean copies and a crosswalk document showing renumbered rules and deletions.
Both agencies emphasized committee review will follow in coming meetings; DOI and DOPL staff said negotiated rulemaking and public hearings will precede final committee action on specific dockets.
