Klamath County officials discuss short-term loan options for Klamath Grown food hub; legal limits noted

County commissioners and staff on May 28 discussed whether Klamath County could provide short-term financing to Klamath Grown, the nonprofit planning a local food hub, to accelerate demolition and construction.

The exchange centered on legal and practical limits. County staff said interfund loans of up to 10 years are permitted for internal funds, but loans to outside entities are “pretty restrictive.” A staff member referenced constitutional limits, saying “isn’t there a constitutional section 9 article 11 or something like that?” and noted there are only limited exceptions for loans to non-municipal entities.

Staff described examples the county has used previously: loans to other governmental units such as a school district and to fire districts, which have taxing authority and a clearer path for repayment. The meeting record shows the county has made loans to municipal entities under statute but that loans to outside nonprofit entities would raise favoritism concerns and require closer legal review.

Commissioners and staff discussed alternatives, including using an interfund loan if the county itself were the borrower (for capital reserve work on a building) or waiting until pledged external funding arrives and then repaying a short-term loan. No motion or formal vote was taken on providing a loan to Klamath Grown during the meeting; staff said they would investigate options and legal constraints further.

The discussion occurred as part of a broader conversation about the county’s economic development priorities and carryover funds available for projects.
