At its public meeting, the Nevada Commission on Ethics approved a stipulated agreement resolving complaint 20Four-109C against Charles Green, secretary-treasurer of the Board of Homeopathic Medical Examiners.
The agreement, summarized by Executive Director Russell Armstrong, resolves an allegation that Green “did not appropriately disclose or abstain during a public meeting of the Board of Homeopathic Medical Examiners” when the board voted on compensating him for services. Armstrong told the commission that the board’s enabling statute specifically allows payment to a secretary-treasurer, and he described the resolution as balancing enforcement and education.
Under the terms the commission accepted, Green agreed to a finding of one nonwillful violation of the disclosure rule in NRS 281A.420(1); he will pay a $500 monetary penalty, $250 of which will be suspended; he will provide the board the information and materials needed to continue its work; he will no longer serve on the board; and if he returns to public service he must complete training. The stipulated agreement also included an admonishment from the commission.
Attorney Tanner appeared for Charles Green and indicated no objection to the recitation of the terms. Executive Director Armstrong and staff described operational factors the commission considered, including that Green had performed years of service for a small board with a limited budget and that there were procedural shortcomings in how the meeting was run that may have limited opportunities for clear disclosures.
Commissioner Miller moved to accept the terms of the stipulated agreement and to direct commission counsel to formalize the agreement in the appropriate legal form. The motion was seconded. The commission recorded the outcome as approved with a 5–0 tally in favor; Commissioners Lowery and Vice Chair Wallen abstained because they had served on the review panel and were precluded under NRS 281.8.220(4).
The commission’s staff noted separate, ongoing administrative work by the Department of Business and Industry related to some facts in the matter.
