Minutes: The committee voted to approve the minutes of the May 27 ZLR Committee meeting by voice vote after a motion was offered and seconded; the chair announced the motion carried.
Rezoning petitions forwarded to County Board: The committee approved revised rezoning petitions that will be forwarded to the Dane County Board for final action at the June 26 County Board meeting. Staff recommended approval of the following, subject to the conditions noted by staff: - Rezone petition 12158 (Tim and Jory Properties LLC, Town of Rutland): Approved with revised lot layout assigning RR8 zoning to the residential lot and FP1 (farmland preservation) to remaining agricultural land; staff required a deed notice on the FP1 land identifying two remaining housing-density rights and recording of a certified survey map. Motion by Jeffrey Kronig; second by Jerry Bollig. The committee voted by voice and the chair announced the motion carried. - Rezone petition 12159 (Kurt and Eileen Eilenfeldt, Town of Cottage Grove): Approved subject to conditions listed on the agenda, including documentation of transfer of development rights and applying the TDR receiving overlay. Motion by Jerry Bollig; second by Jeffrey Kronig. Voice vote carried. - Rezone petition 1200160 (Kirk and Heidi Eilenfeldt, Town of Cottage Grove): Approved with revised layout and RR2 zoning for a 2-acre lot; conditioned on recording a certified survey map and TDR documentation. Motion by Jeffrey Kronig; second by Jerry Bollig. Voice vote carried. - Rezone petition 12164 (Lisonbee Rodriguez and Josue Rodriguez Moreno, Town of Cottage Grove): Approved as recommended by staff with no conditions. Conditional-use permit (final action by committee): CUP petition 2660 (Lisonbee Rodriguez and Josue Rodriguez Moreno, Town of Cottage Grove) — The committee approved a conditional-use permit to operate a limited family contractor business from a detached garage and new pole barn subject to 18 conditions, six of which are unique to this permit. Key conditions noted by staff include limits from Chapter 10, restriction to one full-time equivalent employee who is not family, hours of operation from 7:30 a.m. to 5:30 p.m. Monday through Friday, prohibition on outdoor storage, prohibition on sanitary fixtures draining into accessory buildings, a required second access onto West Ridge Road rather than a driveway around the back of the house, and automatic expiration of the permit if the business or property is sold to an unrelated third party. Motion by Jeffrey Kronig; second by Jerry Bollig. Voice vote carried.
Land-division waiver: The committee denied a land-division waiver for proposed lots lacking road frontage (see separate item). Motion by Jerry Bollig; second by Jeffrey Kronig. Voice vote carried.
Several of the rezoning items were described by staff as returning to the committee after town actions and revisions to layouts. For petitions that the committee approves, staff will forward the petitions to the county board or record required deed notices and certified survey maps as conditions specify.
