ZLR Committee denies land-division waiver for parcels lacking road frontage in Cross Plains area

The Dane County Zoning and Land Regulation (ZLR) Committee on June 10 denied a land-division waiver request for two proposed lots that would not have public road frontage west of County Highway S, citing county road-frontage standards and the need for a rezone petition and density study.
Dan Iverson, assistant zoning administrator, told the committee the county requires at least 66 feet of road frontage for lots under 35 acres and that an exception for shared access easements applies only to up to four residential lots when one lot retains 66 feet of frontage. "Staff also feels that this particular waiver application is premature, due to the fact that a rezone petition has not been submitted," Iverson said. He recommended the applicant first pursue alternatives including a rezone and a density study so towns can provide formal input.
The application concerns land owned by a single owner spanning the towns of Cross Plains and Springdale. Iverson said county highway staff noted a change-of-use permit would be required for the proposed access; he also flagged long-term complications from lots that cross town boundaries and the possibility of future additional splits if the waiver were granted.
Chris Adams, the land surveyor for the applicant, told the committee he had held a preliminary consult with the town of Cross Plains and that the town had said it "would be acceptable to it as well" if the county approved a waiver, but he acknowledged the property's two-township layout creates complications. Adams said the owner believes there are three remaining splits in Cross Plains and none in Springdale, but Iverson and planning staff said a formal density study was needed to confirm that.
Supervisor Jerry Bollig moved to deny the waiver and Supervisor Jeffrey Kronig seconded. The committee voted by voice; the chair announced the motion carried.
Staff recommended denial and advised the applicant to pursue a rezone petition with a density study or explore transfer-of-development-rights options with the town as alternatives. The committee took no other action on the parcel at the meeting.
