The Planning Commission approved ZTA 25-05 to allow child care centers as a conditional use within the AR Agricultural-Residential district, a staff-initiated amendment aimed at expanding rural childcare access.
Staff said demand for childcare in rural parts of the county motivated the proposal. The amendment would allow daycare operations in most residential districts, clarify the definition of a childcare center, and remove certain requirements that previously constrained rural providers. Commissioners asked whether the change would create conflicts with definitions for schools; staff said education use-group definitions remain and that staff will determine the appropriate use group in ambiguous cases, with development still subject to Technical Review Committee processes and applicable development standards.
A motion to approve the text amendment passed by voice vote. Staff noted the amendment would align zoning allowances for daycare and education uses in most districts and reduce administrative barriers for childcare providers, though specific development requirements and permitting will still apply.
The amendment removes the requirement for applicants to seek relief from the Board of Zoning Appeals in many cases; applicants will still need to obtain TRC review and meet development standards for any new facility.
